OVERALL NEW RULES

1. Listing agents and sellers are prohibited from advertising in the MLS how much they are offering to pay a buyers agent
2. Buyers are required to sign a Buyer Representation agreement at the beginning of their search/prior to writing offers outlining how much they will be paying their agent

HOW WILL THIS CHANGE THINGS
1. Buyers who cannot pay to cover their buyers agent can (1) negotiate a lesser fee with their Realtor OR (2) when writing or submitting an offer, ask the seller to cover some or all of those costs with their offer OR (3) when writing and submitting an offer, ask the listing agent to cover some or all of those costs through their commission.
2. When your agents commission is part of your offer to the seller, that will be a negotiation point when in multiple offer situations. An offer at $1mill where the seller is asked to pay 1% to cover a Buyers agent fee is a more competitive offer than a $1mi offer where the Seller is asked to pay 2.5% to cover a Buyers agent fee
3. Low down payment Buyers who are buying on the lower end will be more red likely to need these concessions paid. The luxury market may see less concessions from sellers as they often have more assets to cover costs. As such, lenders will need to adjust their programs to allow high seller concessions. 

WILL AGENTS MAKE MORE OR LESS?
Traditionally listing agents would charge an amount and share a portion of it with the buyers agent. It’s yet to be seen if sellers will tolerate an agent charging 4,5,6% or more if they are not sharing it with a buyers agent. 

Fees have ALWAYS been negotiable on both sides of the transaction. However, this will absolutely open up negotiations more between buyers and their Realtors.
